Terms of Service
These Terms of Service govern your use of the RscMe mobile application and related website operated by HorMart s.r.o.
Acceptance of terms
By downloading or using RscMe, you agree to these Terms. If you do not agree, do not use the app.
Service description
RscMe monitors heart rate data from Apple Watch and sends SMS alerts to user-selected contacts when configured alert conditions are met.
Apple Watch and iPhone requirements
Apple Watch is required for monitoring. In normal use, iPhone should be nearby so SMS alerts can be sent.
Alert Credits and purchases
SMS alerts require Alert Credits purchased through Apple App Store in-app purchases. Credits never expire unless required otherwise by applicable law or platform policy changes. Each alert uses 1 credit per contact, and alerts are only sent when sufficient credits are available.
Refunds
Refunds and payment disputes are handled according to Apple App Store policies. HorMart does not control App Store refund decisions.
Emergency and medical disclaimer
RscMe is not a medical device and does not diagnose, treat, cure, or prevent disease. RscMe does not detect heart attacks. RscMe does not call 911 or emergency services.
Alert delivery is not guaranteed. Functionality depends on Apple Watch, iPhone, battery level, permissions, network connectivity, carrier/SMS availability, iCloud/App Store availability, and available Alert Credits.
User responsibilities
You are responsible for correct setup, maintaining permissions, selecting reliable emergency contacts, and keeping your device and account information up to date.
Availability and limitations
We may update, suspend, or limit parts of the service from time to time. Features may vary by device, iOS/watchOS version, region, or third-party service availability.
Privacy
Your use of RscMe is also subject to our Privacy Policy.
Third-party services
RscMe depends on third-party services such as Apple Health/HealthKit, iCloud, App Store billing, mobile carriers, and SMS providers (including Twilio where needed). Their own terms and policies apply.
Intellectual property
The app, website, branding, and related content are owned by HorMart s.r.o. or its licensors and are protected by applicable intellectual property laws.
Termination
We may suspend or terminate access to the service if these Terms are violated or if required to protect users, comply with law, or maintain service integrity.
Limitation of liability
To the maximum extent permitted by law, HorMart is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from service interruptions, delayed alerts, failed delivery, or third-party service failures.
Governing law
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules.
Changes to terms
We may update these Terms. Updated versions are posted on this page with a revised effective date.
